Procedures for applying for DN1 and DN2 business visas for foreigners

Regulations on Vietnamese business visas

Business visa or commercial visa has the English name Business visa . A visa for foreigners to enter Vietnam to work at companies and organizations in Vietnam. Companies often make DN1 visas for experts and technical workers.

Business visa duration

Business visa has a maximum validity of 1 year. However, in reality, visas are only granted from 1 month to a maximum of 3 months. Therefore, many people often ask about: 3-month multiple-entry visa and 3-month single-entry visa.

Types of business visas

According to the revised Immigration Law 2019, there are 2 types of Business visas: DN1 and DN2.

 

Visa DN1

A commercial visa issued to foreigners working with businesses and organizations with legal status.

Businesses that want to invite foreigners to work will have to sponsor them to apply for a dn1 visa . Businesses that sponsor foreigners  are usually:

• • Co., Ltd.
  • Joint Stock Company.
  • Branches of limited liability companies and joint stock companies.
  • The company has foreign investment capital.
  • Domestic company (100% Vietnamese capital).

Visa DN2

It is a commercial visa issued to foreigners entering to offer services, establish a commercial presence… international treaties to which Vietnam is a member.

The dn2 visa is not as popular as the dn1 visa and does not require foreigners to work at the sponsoring enterprise. However, the guarantee company is still responsible for guaranteeing and ensuring foreigners enter the country and operate for the right purposes while they are in Vietnam.

In addition, people can classify business visas based on the visa’s duration and number of entries and exits. You may often hear about: 3-month multiple-entry visa and 3-month single-entry visa

 

3 month multiple entry visa

The 3-month multiple entry business visa is valid for 3 months and allows foreigners to enter and exit the country multiple times. Multiple times means unlimited number of exits and entries, until the visa expires.

This is a common type of visa that foreigners use to enter Vietnam.

 

Visa for 3 months at a time

The 3-month single-entry business visa also has a validity of 3 months. But there is only one entry and exit. The visa will expire immediately when the foreigner uses up the number of entries and exits.

 

Business visa application for foreigners

Documents that need to be prepared to sponsor a business visa for foreigners include:

1. Operating license of the guarantee company

– Business registration: Notarized copy

– Investment certificate (for companies with foreign investment): notarized

– Conditional business license (Sublicense (if any)): notarized

2. Form NA2 – sponsorship application for foreigners entering the country

Currently, this application must be declared online. Then print it out, then sign and stamp the company seal.

The business visa application process is guaranteed by the company

4 steps to carry out sponsorship procedures for foreigners applying for a business visa are as follows:

1. Prepare documents

Prepare at least 01 set of documents as instructed above.

2. Submit application

Applications are submitted to the Vietnam Immigration Department.

There are 2 ways to apply for entry approval for businesses:

– Submit application directly to the Immigration Department (Hanoi, Ho Chi Minh)

– Submit online application (Enterprises must register an account with the Immigration Department)

3. Get results

After submitting your application, you will receive an appointment letter. You receive results according to the time and address listed on it.

Processing time is about 5 working days.

4. Receive DN1 visa

There are 2 places for foreigners to receive visas

– Vietnamese Embassy abroad

– Vietnam international border gates (For example: Noi Ba, Tan Son Nhat, Huu Nghi…)

The place of visa receipt must be recorded on form NA2 before submitting the application.

 

Extend DN1 visa for another 1 month

You can extend for another 1 month your DN1 business visa that is about to expire. This helps foreigners stay in Vietnam for another month without leaving the country when their visa expires.

DN1 visa extension documents:

• • Form NA5:  Confirmed by the guarantee company.
  • Passport of foreigners: original.
  • Temporary residence declaration: copy.
  • Sample explanation of reasons.

Visa extension fee is $10/1 extension.

 

Change guarantee company

This is when a foreigner is in Vietnam under the sponsorship of one company, then moves to another company to work.

Documents needed to prepare to change guarantee company:

• • Decision to quit the old guarantee company: original or notarized
  • Form NA5:  Confirmed by the new guarantee company.
  • Passport of foreigners: original.
  • Work permit/confirmation of work permit exemption at new company: notarized
  • Temporary residence declaration: copy.
  • Sample explanation of reasons.
